Tactical Trader Service Agreement

TERMS OF AGREEMENT: A "ChangeWave Tactical Trader" subscription begins upon acceptance of your subscription fee.

COPYRIGHT: The material contained within "ChangeWave Tactical Trader" is confidential and proprietary to ChangeWave Research (CWR) and protected under the copyright laws of the United States. You may not reproduce, distribute or disclose its contents without the prior express approval of CWR. In the event you breach this provision, in addition to all other available remedies, CWR may collect from you its costs, including reasonable attorney's fees, incurred in enforcing this provision.

DELIVERY: "ChangeWave Tactical Trader" is delivered through the services of a third party carrier. CWR does not warrant that the transmission will be uninterrupted or error free. CWR will not be liable for the acts or omissions of any third party with regards to delay or non-delivery of the "ChangeWave Tactical Trader" notification. In the event of non-delivery of a "ChangeWave Tactical Trader" notification due to acts or omissions of CWR, CWR will provide a pro-rata refund or credit for the portion of "ChangeWave Tactical Trader" which was not delivered. In no event will CWR be responsible for damages in excess of the subscription price paid to CWR.

LIMITATION OF LIABILITY: Investing in microcap stocks is risky. CWR does not guarantee the success of the recommendations made in "ChangeWave Tactical Trader." Use of this service is strictly at the subscriber's own risk. CWR shall not be liable for incidental, indirect, special or consequential damages or for lost profits, savings, or revenues of any kind, whether or not CWR has been advised of the possibility for such damages. CWR makes no warranties, express or implied, and specifically disclaims any warranty of merchantability of fitness for a particular purpose as to "ChangeWave Tactical Trader."
